1. Introduction
Welcome to the Sustainable Disadvantaged Development Foundation (SDDF). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Participant," or "Donor") and SDDF ("Foundation," "we," "us," or "our"). These Terms govern your access to and use of our website located at https://sddf.org/ ("Site"), as well as your participation in our training programs, research initiatives, and donation activities.
By accessing this Site, registering for a course, or making a donation, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accessing these Terms on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Modifications: SDDF reserves the right to update, change, or replace any part of these Terms at its sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2. Educational Services & Training
SDDF provides specialized, research-based training programs aimed at enhancing skills in data analysis, research methodology, and development studies. By enrolling in our programs, you agree to the following operational policies:
2.1 Certification Policy
SDDF takes pride in the integrity of its certification process. Certificates are not guaranteed solely by registration. To qualify for a Certificate of Completion, participants must:
- Maintain a minimum attendance record (typically 80% of live sessions, unless otherwise specified).
- Successfully submit all required assignments, projects, or assessments within the stipulated deadlines.
- Adhere to academic integrity standards; plagiarism in assignments will result in immediate disqualification.
SDDF reserves the right to withhold or revoke certification if a participant fails to meet these academic standards or engages in misconduct during the training period.
2.2 Course Content and Scheduling
While we strive to adhere to the published curriculum, SDDF reserves the right to modify course content, instructors, or schedules due to unforeseen circumstances or to improve the quality of training. Registered participants will be notified of significant changes via email or the learning management platform.
3. Donations and Financial Transparency
As a non-profit organization dedicated to sustainable development, SDDF relies on the generosity of individuals and organizations. By supporting us, you agree to the following:
- Voluntary Contribution: All donations are voluntary and non-reciprocal. By making a donation, you confirm that the funds are your own and not proceeds of crime or money laundering activities.
- Utilization of Funds: SDDF is committed to financial transparency. Donations are utilized for research projects, skill development programs for the disadvantaged, and operational costs. Specific fund allocation reports are available in our Annual Report.
- Refund Policy: Donations are generally considered non-refundable once processed. Exceptions are made solely for technical errors (e.g., duplicate processing) if reported within 48 hours to info@sddf.org.
- Tax Receipts: Donors may be eligible for tax benefits under the laws of Bangladesh. Official money receipts will be issued via email upon successful transaction completion.
4. Intellectual Property Rights
The entire content included in this Site and our training materials is the exclusive property of SDDF or its licensors.
4.1 Ownership
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content") contained on the Site is owned, controlled, or licensed by or to SDDF, and is protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.
4.2 Permitted and Prohibited Uses
You may: Download one copy of the materials (such as research reports or public brochures) on the Site for personal, non-commercial transitory viewing only.
You may not:
- Modify or copy the materials for commercial use or public display.
- Attempt to decompile or reverse engineer any software contained on the SDDF website.
- Remove any copyright or other proprietary notations from the materials.
- Transfer the materials to another person or "mirror" the materials on any other server.
- Use data mining, robots, or similar data gathering and extraction tools on the Site.
5. User Conduct and Community Guidelines
SDDF fosters a respectful and collaborative environment for researchers, students, and beneficiaries. You agree strictly not to use the Site or our services for any of the following:
- Unlawful Purposes: Using the Site for any purpose that is illegal or prohibited by these Terms.
- Harassment: Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
- Security Violations: Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Site.
- Misrepresentation: Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, or hiding or attempting to hide your identity.
Violation of these guidelines may result in immediate termination of your access to our services and, where appropriate, legal action.
6. Limitation of Liability and Indemnification
6.1 Disclaimer of Warranties
The materials on the SDDF website are provided on an 'as is' and 'as available' basis. SDDF makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
6.2 Limitation of Liability
In no event shall SDDF, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.
6.3 Indemnification
You agree to defend, indemnify, and hold harmless SDDF and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict of law provisions.
Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
